How to get product documents according to the rules of Customs Union

Perhaps, every serious beginning faced certain difficulties. The CU of Russia, Kazakhstan and Belarus isn’t exception. Orientation on the new rules of estimation of conformity has caused appearance of lots of questions and problems, except positive consequences. Lets look at the main.

Since July 1 of 2010 new rules of estimation of conformity, accepted in Customs Union, have started to act. As a result, producers now can get certificate of conformity/declaration of conformity according to these rules and the documents are drew up at the unique blanks for countries-members of CU. Despite this fact, declarants have a choice until 01.01.2012: to draw up certificate of conformity and declaration of conformity according to the law of his country – member of CU. As for foreign producer’s products it should get the certificate or declaration according to the law of country-member of CU or according to the unique form.

Certification of conformity is made traditionally by certification authorities, which according to the new rules must be included to the Unique list of certification authorities and testing-rooms of Customs Union. Until the end of forming this list, protocols from special accredited testing-rooms are acceptable. Production, mentioned at the Unique list of production submitted to necessary estimation of conformity in borders of Customs Union with issue of unique documents.

Production that was not included in this Unique list must pass confirmation of conformity according to the current law of countries-members of CU.

State registration is one of the forms of confirmation of conformity. Before 01.07.2010 for production that is submitted to sanitary-and-epidemiologic certification was required to draw up certificate/declaration of conformity. After coming into force Customs Union this requirement was cancelled. There’s plans to require only one document for circulation of commodities inside the CU: either certificate/declaration of conformity or certification of state registration.

State registration is required for products that is produced or imported into the territory of Customs union for the first time.

The problem is which document from two mentioned above is required to draw up.

Perhaps, the most shocking news became cancellation of drawing up sanitary-and-epidemiologic certification. Now producers must follow Unique list of goods submitted to sanitary-and-epidemiologic control on customs border and customs territory of Customs Union.

Cancellation of SEC, according to information from official site of Rospotrebnadzor, is explained by absenting in Sanitary Measures Agreement of Customs Union confirmation of safety goods in form of SEC.

As for production, submitted to SEC before and which is not require state certificate nowadays, for it will be drown up declaration of conformation with the participation of third party.

Appeared problems and difficulties testify that everything is not smoothly in the Customs Union. Probably, passing to the new rules was very fast, this is why there’s reason to think about realizing the idea (which is in common directed on positive changes) and in more details work at schemes of realization.
