Product Certification

When importing goods into the territory of the Russian Federation as well as using them afterwards, one must take into account the legal requirements for certification.

The list of goods subject to mandatory certification for imports is approved by the Federal Customs Service of Russia and is periodically updated.

Thereby, before the delivery of goods it is necessary to ensure that you have all the required permits.

The most frequently required certificates are the following:



GOST - Certificate for compliance with the standard norms of the Russian Federation.

 



There are several types of GOST - Certificate:

1. ertificate for a consignment in this case a certificate is issued with a binding to a specific shipment of goods. It includes details of the contract, invoice, and the number of certified products. An importer of goods (the recipient) is necessarily indicated in this type of certificate, and it can not be used by other importers. The validity of the certificate is limited by particular delivery.

2. certificate for a contract the certificate is also issued with links to the importer and the contract for the supply. The term of the certificate is usually from 1 to 3 years.

3. certificate for serial production - the certificate is issued to the products manufacturer and can be used by any importer. The validity of this certificate may vary from 1 to 3 years.


It must be remembered that during customs clearance your buyer has to present a notarized copy of a certificate or a copy certified by the authority which issued the certificate. Thats why we suggest that you pre-arrange sending certified certificates to your customers, in order not to hinder the process of registration, thereby loosing time and money in the warehouse of temporary storage.









Sanitary-Epidemiological Conclusion (Hygiene Certificate) a document issued by the Federal Service for Supervision of Consumer Rights Protection and Human Welfare.

 


This document is required primarily for goods that directly contact with person while being used: such as clothing, food, household chemicals, etc. This conclusion is valid for 3 years or 5 years. Regardless of the term, it may be issued for the goods manufacturer as well as for the importer.







Since July 1, 2010 safety of the products have to be confirmed by presenting a Certificate of State Registration. This document must now be obtained and presented instead of Hygiene Certificate (Sanitary-Epidemiological Conclusion), which used to be issued earlier.

Sanitary-Epidemiological Conclusions issued before July 1, 2010 are still valid till January 1, 2012 on the territory of the Russian Federation. But on the territory of the rest countries of the Customs Union (Kazakhstan and Belarus) these Hygiene Certificates are no longer valid.

 


So, Certificate of State Registration is a document, which proves that tested products confirm to the State Sanitary and Epidemiological Regulations. Primarily, the following groups of products are subject to go through the process of State Registration: food, cosmetics, products of personal hygiene, cleaning and washing agents, potentially dangerous for a person chemicals, items that contact with food. Full list of products is indicated in the Decision of the Commission of the Customs Union #299 dated May 28, 2010.

Certificate of State Registration is issued by RosPotrebNadzor (Russian Federal Supervisory Agency for Consumer Goods) and valid on the whole territory of the Customs Union without any limitation time.

Process of State Registration includes:

1. Expertise of the results of performed tests, toxicological and hygienic and other evaluations (as called laboratory tests);

2. Consideration of the documents presented by the applicant concerning testing products (for each group there is own list of documents);

3. Decision whether to issue or not the Certificate of State Registration; including of the approved products to the State Register of Products, Processed through State Registration"

4. Issuing of the Certificate of State Registration to the applicant.

As applicant there might be either the Manufacturer or their Representative.


It is strictly forbidden to export the products to the Russian Federation (or Belarus and Kazakhstan) that are subject to State Registration but have not been passed through this process.








Certificate of Fire Safety (Fire Certificate) is a document that certifies conformity of the product to the fire safety requirements.

Certificate of Fire Safety is one of the most important documents for manufacturers, who export their products to the Russian Federation. This document is necessary to be presented before applying for a GOST or a Gosstroy Conformity Certificates and also it would be presented to the customs.

 


Certification of Fire Safety might also be voluntary as well as compulsory one. The list of the products that should be compulsorily certified according to the fire safety requirements is defined in the Federal Law #123 The Technical Regulation of Fire Safety Requirements" dated 22.07.2008.

There is also another document that may confirm that a product satisfies to fire safety requirements it is a Declaration of Fire Safety. The main difference between these two documents (certificate and declaration) is that for a Certificate might apply either a Non-Russian manufacturer or a Russian importer, while only companies registered in Russia (importer, representative etc.) have a right to apply for a Declaration. Nevertheless, both documents have equal validity.

Fire Certificates/Declarations have limited duration period. Depending on the scheme of testing the validity period may be 1, 3 or 5 years for serial production. If the certificate/declaration is issued for the exact party of the products, then the document is valid during the warranty period of the products.







Declaration of Fire Safety

There is also another document that may confirm that a product satisfies to fire safety requirements it is a Declaration of Fire Safety. The main difference between these two documents (certificate and declaration) is that for a Certificate might apply either a Non-Russian manufacturer or a Russian importer, while only companies registered in Russia (importer, representative etc.) have a right to apply for a Declaration. Nevertheless, both documents have equal validity.

 


Fire Certificates/Declarations have limited duration period. Depending on the scheme of testing the validity period may be 1, 3 or 5 years for serial production. If the certificate/declaration is issued for the exact party of the products, then the document is valid during the warranty period of the products.







Declaration of Conformity (to the State Standards - GOST) is a document, by which the manufacturer (seller, exporter) certifies that exported goods comply with the regulations for that type of products. Nowadays Declaration of Conformity is admitted as an alternative for a Certificate of Conformity.

Declaration of Conformity should be issued for the goods, that are included to the List of The Products Subject to be Certified for Compliance by Presenting of the Declaration of Conformity" (Government decree of the Russian Federation #982 dated December 01, 2009).

 


Only companies registered on the territory of the Russian Federation (whether they are importers, representatives, distributors etc.) on behalf of the manufacturer may apply for the Declaration of Conformity. This document can be issued as for serial production (for a contract) so for an exact party of the goods.

Declaration of Conformity has the same validity as a Certificate of Conformity and time limitation up to three years.







Certificate of Conformity to the Technical Regulations Concerning Machines and Equipment Safety"

The Technical Regulations Concerning machines and equipment safety" #753 came into force on 25.09.2010. These Regulations appoint compulsory certification of equipment listed in the Regulations with issuing of a Certificate of a new form (instead of Certificate of Conformity with State Standards GOST), which is valid for 5 years.

 


The present Regulations determine minimal necessary requirements for machines and equipment safety during their projecting, production, assembling, adjustment, operation, storage, transportation, selling and utilization.

The process of applying for a Certificate of Conformity to the Technical Regulations is the same as that to the GOST Certificate.

Certain types of activities and implementation of certain groups of products require a license. It is usually an importers due to obtain a license, however we find it reasonable to ascertain whether your partner posses required papers before entering into a contract.
