Particulars of getting the certificates for import of goods on the territory of the Customs Union (Russia, Kazakhstan, Belarus) in 2012-2014

The new form of trade and economic relationships between Russia, Kazakhstan and Belarus is present since the 1st July 2010. It creates the common customs territory for all participating countries. No doubts that creation of such integration inflicts not only on relationships between three counties which participate in it, but also on other players of the international market.

For importers the most remarkable change is the new process of getting authorizations (conformance certificate, declaration of conformity) to import the goods on the territory of the Customs Union (CU).

Since the June of the 2012 the new technical rules of the Customs Union (TR CU) are coming into force gradually replacing the prior certification system of Russian National Standards (GOST R). Thus there are three certification systems in Russia now: Russian National Standards (GOST R), Technical rules of the Russian Federation (TR RF) and Technical rules of the Customs Union (TR CU). The certification system GOST R will not be used after TR CU becomes fully operative.

No wonder, that for unprepared importer or exporter is hard to understand a system like this. Practically every month one of the new TR CU becomes operative and replaces the certain GOST R certificate. This period is quite risky and the correct certification of import goods becomes a difficult task.

It is worth noting that there is a double risk while import of goods, because the certificates and declarations which are not executed in a proper way will cause great extension of terms of the customs clearance and storage expenses. Moreover, the cost of preparing of the necessary certificates will increase due to the urgency.

It is reasonable to ask for help of the specialists, rather than trying to get necessary documents on your own. This will afford you to save time and decrease the price of certification; also it helps to avoid probable problems during customs clearance of goods imported on the territory of the CU.

Recently our company have many recourses from importers who have faced problems while customs clearance of import goods. Let us name the main problems which appear in process of certification for import:

  • Discrepancy between the required documentation, which approves the quality of the goods, for the Customs and Certification authorities. This may be a certificate or declaration of conformity. In our practice there were some cases when the customs authority asked for one document, for example certificate of conformity, while the certificate authorities insist on the declaration of conformity. The price and terms of getting of these documents differ dramatically, especially according to new technical rules. First of all it refers to technical production which earlier should be certificated by the GOST R certificate of conformity, and after technical rules of the CU become operative, need TR CU conformity declaration.
  • In some cases the certification for this particular product is not necessary at all, but the customs authorities insist on receiving of a document which approves the quality of the product. For example, customs authorities have demanded from the importer the State Registration Certificate for the vitamin beverage from Finland. Our specialists have investigated the situation. As a result, to the customs authorities was sent the exemption letter. This document was issued by the “Federal Service on Customers’ Rights Protection and Human Well-Being Surveillance” and approved that the goods do not require the state registration.
  • Since the TR CU became operative, the procedure of getting the certificate of conformity according to the TR CU has become much more difficult. For instance, confirmation of the quality of personal protection equipment requires not only examples of all the supplied production, but also the departure of expert from a certificate authority to the factory. This new requirement refers to most of the products which require getting of the certificate of conformity according to the TR CU. But the departure to the factory is quite expensive and not all companies can afford it.


Make request for Providing product certification 

Getting of the test protocol from the certification authority requires special attention. Federal Accreditation Service has started the work of creating the Unified register of test protocols. According to the official sources, the laboratories will be obliged to make entries to the Unified register about all test protocols which allowed to issue the authorization document (certificate or declaration). Creation of the Unified register will let to decrease usage of the fake test protocols. Please, take a notice, that there are cases when companies which provide cervices of getting the certificates offer to issue the certificate in form of GOST R backdate and thereby lower the cost of certification. However, the documentation issued in such way is not listed in the register. The importer finds out that the certificate is forged only while customs clearance. So the attempt to save on the certification creates huge problems.

During the period of changes in the authorization documents issue standards, it is easier for resident to control the changes in regulatory documents. Meanwhile, the foreign companies which are going to sell their production on the Russian market do not have the information about changes in the procedure of getting certificates. Therefore they get into situation, when the present documents are not enough for import customs clearance.
